A classic debate concerns whether reasonableness should be understood statistically (e.g., reasonableness is what is common) or prescriptively (e.g., reasonableness is what is good). This Article elaborates and defends a third possibility. Reasonableness is a partly statistical and partly prescriptive “hybrid,” reflecting both statistical and prescriptive considerations. Experiments reveal that people apply reasonableness as a hybrid concept, and the Article argues that a hybrid account offers the best general theory of reasonableness. -/- First, the Article investigates how ordinary people judge (...) what is reasonable. Reasonableness sits at the core of countless legal standards, yet little work has investigated how ordinary people (i.e., potential jurors) actually make reasonableness judgments. Experiments reveal that judgments of reasonableness are systematically intermediate between judgments of the relevant average and ideal across numerous legal domains. For example, participants’ mean judgment of the legally reasonable number of weeks’ delay before a criminal trial (ten weeks) falls between the judged average (seventeen weeks) and ideal (seven weeks). So too for the reasonable num- ber of days to accept a contract offer, the reasonable rate of attorneys’ fees, the reasonable loan interest rate, and the reasonable annual number of loud events on a football field in a residential neighborhood. Judgment of reasonableness is better predicted by both statistical and prescriptive factors than by either factor alone. -/- This Article uses this experimental discovery to develop a normative view of reasonableness. It elaborates an account of reasonableness as a hybrid standard, arguing that this view offers the best general theory of reasonableness, one that applies correctly across multiple legal domains. Moreover, this hybrid feature is the historical essence of legal reasonableness: the original use of the “reasonable person” and the “man on the Clapham omnibus” aimed to reflect both statistical and prescriptive considerations. Empirically, reasonableness is a hybrid judgment. And normatively, reasonableness should be applied as a hybrid standard. (shrink)

A formal theory of oppositions and opposites is proposed on the basis of a non- Fregean semantics, where opposites are negation-forming operators that shed some new light on the connection between opposition and negation. The paper proceeds as follows. After recalling the historical background, oppositions and opposites are compared from a mathematical perspective: the first occurs as a relation, the second as a function. Then the main point of the paper appears with a calculus of oppositions, by means of a (...) non-Fregean semantics that redefines the logical values of various sorts of sentences. A num- ber of topics are then addressed in the light of this algebraic semantics, namely: how to construct value-functional operators for any logical opposition, beyond the classical case of contradiction; Blanché's "closure problem", i.e., how to find a complete structure connecting the sixteen binary sentences with one another. All of this is meant to devise an abstract theory of opposition: it encompasses the relation of consequence as subalternation, while relying upon the use of a primary "proto- negation" that turns any relatum into an opposite. This results in sentential negations that proceed as intensional operators, while negation is broadly viewed as a difference-forming operator without special constraints on it. (shrink)

Die Diversität von Nahrungspflanzen, ein Ergebnis Jahrtausende langer Zuchtbemühungen, ist in den letzten Jahrzehnten dramatisch zurückgegangen. Schätzungen zufolge machen von den über 7000 Nahrungspflanzenarten ganze 103 Sorten 90% der Nahrungsmittelproduktion aus. Dieser Verlust könnte in Zukunft gewaltige negative Auswirkungen auf die Nahrungsmittelsicherheit haben, da die Biodiversität eine zentrale Rolle bei der Absorbierung biotischer und abiotischer Stressfaktoren spielt, die auf die Pflanzen wirken. Darüber hinaus stellt der Verlust eine bedeutende Verarmung nicht nur des Pools genetischer Ressourcen dar, die zukünftigen Generationen zur (...) Verfügung stehen, sondern auch der kulturellen Diversität, indem die Nahrungsmittelvielfalt der Landesküchen eingeschränkt und sowohl Kulturlandschaften als auch Stadtgärten vereinheitlicht werden. Wegen der grundlegenden Funktion, die die Agrobiodiversität in der menschlichen Gesellschaft erfüllt, werden wir im Folgenden verschiedene Schwierigkeiten bei der Pflege der Agrobiodiversität als ein gemeinsames Erbe der Menschheit in einer stark ungleichen Welt erörtern. Zuvor jedoch möchten wir untersuchen, was Agrobiodiversität eigentlich ist und welche Funktion sie für das menschliche Wohlbefinden erfüllt. Ziel dieses Artikels ist zu zeigen, inwieweit sich verschiedene Anreizsysteme unterschiedlich auf den Erhalt von Agrobiodiversität auswirken. (shrink)

Ich rekonstruiere und kritisiere Hans Drieschs Argumentation für die Behauptung, daß biologischen Prozessen nur eine substanzdualistische Ontologie der belebten Materie (Vitalismus) gerecht werden kann. Meine Diagnose lautet, daß Drieschs Argumentation zwar logisch schlüssig ist bzw. durch leichte Modifikationen in eine logisch gültige Form gebracht werden kann, aber von empirisch unbegründeten, metaphysischen Prämissen über die Möglichkeiten eines energieumwandelnden Mechanismus ausgeht.

We propose a logic to reason about data collected by a num- ber of measurement systems. The semantic of this logic is grounded on the epistemic theory of measurement that gives a central role to measure- ment devices and calibration. In this perspective, the lack of evidences (in the available data) for the truth or falsehood of a proposition requires the introduction of a third truth-value (the undetermined). Moreover, the data collected by a given source are here represented by means (...) of a possible world, which provide a contextual view on the objects in the domain. We approach (possibly) conflicting data coming from different sources in a social choice theoretic fashion: we investigate viable opera- tors to aggregate data and we represent them in our logic by means of suitable (minimal) modal operators. In diesem Aufsatz räume ich mit einigen tiefsitzenden Vorurteilen gegen die methodologische Rolle von Intuitionen in der Philosophie auf. Zunächst wird gezeigt, dass Intuitionen eine zentrale Rolle als epistemische Gründe in Gedankenexperimenten spielen. Aber auch völlig andere Methoden des Philosophierens (wie etwa die Transzendentalpragmatik) kommen ohne Rekurs auf Intuitionen als Gründe letztlich nicht aus. Außerdem kläre ich über die Natur von Intuitionen und deren epistemologischen Status genauer auf. Intuitionen sind fundamentale Gründe, aber sie sind fehlbar, anfechtbar und lassen sich methodisch (...) kontrollieren. Im letzten Teil des Aufsatzes zeige ich, dass Intuitionen auf eine besondere Weise unangreifbar sind: Alle gegen sie gerichteten skeptischen Argumente rekurrieren selbst an irgendeiner Stelle verdeckt auf Intuitionen. Skeptische Generalangriffe auf Intuitionen als valide Gründe untergraben sich also selbst. (shrink)

斯特劳逊 （Strawson）的语义预设概念在语义学和语言哲学研究上颇有建树。尽管如此，语义预设概念一直遭受来自各方面的批判。概要说来，对语义预设概念之批判主要来自两个方面：其一，试图抽去语义预设概念的逻辑基础 ，即非真值概念 (the notion of truthvaluelessness)，从而达到间接地拒斥语义预设概念之目的。其二，直接批判语义预设概念本身。他们或者论证此概念在理论上不自恰或微不足道，或者断定即使此概念本身在理论上自恰，但实为一空 洞无物之概念。因为我们根本找任何一个语义预设的具体例证。所以，语义预设概念不具任何真正的哲学意义。它只是一个当代神话，理应拒斥。 -/- 玻尔(S. Ber)和莱肯(W. Lycan)对语义预设概念的批判集中代表了以上两个方面。据我所知，迄今不曾有人对他们的批判予以全面和公正的反驳，以致于许多人人云亦云，使得他们的论点至今颇有影响。给予玻尔和莱恩的批判以全面反驳乃本文初 衷。于此相关，我以为很有必要澄清对语义预设概念的诸多误解，从而确立一个理论上自恰，实际上可行，和确有实质性内容的语义预设概念。基于以上考虑，我对语义预设概念批判之反驳包括正 反两个方面。在第二节，我试图建立一个自恰，完备，非庸俗的语义预设概念。基于这一概念，第三节对玻尔和莱恩反对语义预设的两个核心批判予以全面反驳。第四节着重辩护非真值概念。本文的最后结论是：各种批判并未损 伤斯特劳逊的语义预设概念的精髓。语 义预设概念非但不是一个当代神话，而且具有重大哲学意义。 .

Kako je moguće baviti se Platonom danas, ukoliko je filozofija „svoje vreme obuhvaćeno mislima“? Autor Platonovom delu ne pristupa kao dogmatskom štivu, već kao tekstu prožetom paradoksima, koje izmiče svakom unapred pripremljenom, šematizovanom modelu čitanja. Obratiti se Platonu kao filozofskoj paradigmi isplativo je ukoliko filozofi koji progovaraju iz dubine vremena mogu nešto važno da nam saopšte i ukoliko smo kadri da im postavimo autentično pitanje. Zato filozofi moraju imati dah delfskog ronioca, jer biser se ne nalazi u svakoj školjci. Knjiga (...) Iz Platonove filozofije ulazi u red značajnih knjiga posvećenih Platonovoj filozofiji. Veći deo knjige je objavljen u časopisima od svetskog ugleda (na nemačkom i engleskom jeziku). Time je njen kvalitet potvrđen recenzijama koje su nastale van domaćih koterija, a delo se samerilo sa aktuelnim pristupima Platonu. Knjiga se bavi problemima koji su formulisani u drugoj polovini prošlog veka (napisano i nenapisano učenje), preko naizgled klasičnih tema (dvostruki paradoks, utemeljenje istorijskog i političkog, eros), do tekstova koji pogađaju fenomen aktuelnosti Platonove teorije i prakse (problemi kongitivne dispozicije i bioetike u Platonovoj filozofiji). Ispred nas je Platon u dijalogu sa filozofskim strujanjima s kraja dvadesetog i početkom ovog veka. Za Irinu Deretić smisao filozofskog dijaloga leži u procenjivanju i odmeravanju stanovišta u raspravi, kako bi se vlastito stanovište preciznije artikulisalo. Ne radi se o utopijskoj komunikativnoj zajednici - već o karakteru filozofskog dijaloga, koji je upućen na unutrašnji, a ne na spoljašnji agon. Platon iz sasvim nesofističkih razloga preuzima metodu sofista kada „slabiju stvar čini jačom“. Tome je suprotna eristička (ne)kultura, u kojoj strasti imaju prevagu na davanjem bilo kakvih, „a kamoli valjanih razloga“, piše Irina Deretić. Iz problematičnosti jezika i sučeljavanja sa bliskim granicama pojmljivosti, ne mora da proizađe i slabost logosa. Naprotiv, snaga logosa je obrnuto proporcionalna sposobnošću da se odredi njegova nemoć. Granicu Platonove misli Irina Deretić jezgrovito formuliše: „Platonov jezik je sav okrenut biću, i usmeren je na saznajno ovladavanje njime. Snaga argumenta učesnika u Platonovim razgovorima upravo se sastoji u njihovoj sposobnosti da tačno pogode stvarnost na koju se odnose i koju nastoje da izraze“. Ali to vodi oblikovanju samog karaktera dijaloga: sagovornici se podređuju vođstvu „same stvari“ mišljenja. Međutim, logos nije svemoćan, i inače, a pogotovo ne za Platona. Irina Deretić insistira na autentičnom smislu nemoći logosa kao racionalnog diskursa, koji se pokazuje na odlučujućim mestima, tamo gde njegove refleksije o idejama, posebno o Ideji Dobra bivaju suočene sa granicama njihove saznatljivosti i saopštivosti. Napokon, Platonova okrenutost biću nije dovela do teorije adekvatnosti između bića i jezika, nego do isticanja paradoksa i metafore. A šta je iza njihovog vela - ništa, ili su oni, naprotiv, konstitutivni za biće, da li uopšte može biti odlučeno? U skladu sa filozofskim vjeruju Nikolaja Berđajeva, može se formulisati karakteristika ove važne i lepe knjige: Iz dubine vremena izvire sposobnost da se filozofski misli, a to onda nije u koliziji sa aktuelnim „primenama“ filozofske refleksije. Finding multi-path routes in ad hoc networks due to their grid topology seems to be a trivial task, but because of CSMA/CA effects in these networks found paths are not completely disjoint unless an appropriate algorithm have taken into account. If such an algorithm provided and designed carefully it could improve multi-path video transmission over these kinds of networks. By using node-disjoint paths, it is expected that the end-to-end delay and BER in each case should be independent of each other. (...) However, because of natural properties and medium access mechanisms in ad hoc networks the end-to-end delay and also BER between any source and destination depends on the pattern of communication in the neighborhood region. In this case some of the intermediate nodes should be silent to reverence their neighbors and this matter increases the end-to-end delay. To avoid this problem, multi-path routing algorithms can use zone-disjoint paths instead of node-disjoint paths. In this paper we demonstrated a new multi-path routing algorithm that selects zone-disjoint paths that in addition used for video multi-path transmission over ad hoc networks. It is shown that by using this new algorithm along with choosing an appropriate scheme for video transmission over discovered paths, our approach receives enhanced results comparing previously used algorithms. Clinical evidence has shown that physical exercise during pregnancy may alter brain devel- opment and improve cognitive function of offspring. However, the mechanisms through which maternal exercise might promote such effects are not well understood. The present study examined levels of brain-derived neurotrophic factor (BDNF) and absolute cell num- bers in the hippocampal formation and cerebral cortex of rat pups born from mothers exer- cised during pregnancy. Additionally, we evaluated the cognitive abilities of adult offspring in different behavioral paradigms (exploratory (...) activity and habituation in open field tests, spatial memory in a water maze test, and aversive memory in a step-down inhibitory avoid- ance task). Results showed that maternal exercise during pregnancy increased BDNF lev- els and absolute numbers of neuronal and non-neuronal cells in the hippocampal formation of offspring. No differences in BDNF levels or cell numbers were detected in the cerebral cortex. It was also observed that offspring from exercised mothers exhibited better cognitive performance in nonassociative (habituation) and associative (spatial learning) mnemonic tasks than did offspring from sedentary mothers. Our findings indicate that maternal exer- cise during pregnancy enhances offspring cognitive function (habituation behavior and spa- tial learning) and increases BDNF levels and cell numbers in the hippocampal formation of offspring. »Aber wenn ich höre, alles andere habe vor dem Schutz des Lebens zurückzutreten, dann muss ich sagen: Das ist in dieser Absolutheit nicht richtig. Grundrechte beschränken sich gegenseitig. Wenn es überhaupt einen absoluten Wert in unserem Grundgesetz gibt, dann ist das die Würde des Menschen. Die ist unantastbar. Aber sie schließt nicht aus, dass wir sterben müssen.« So äußerte sich Wolfgang Schäuble im April 2020 im Zusammenhang mit den Maßnahmen gegen die Corona-Pandemie. Die fundamentale Stellung der Menschenwürde, die Schäuble in (...) seiner Aussage hervorhob, steht außer Streit. Der Schutz der Würde des Menschen bildet so etwas wie den Ankerpunkt, das Umwillen der Rechtsordnung. Was die Menschenwürde genau bedeutet, ist jedoch alles andere als klar. In der juristischen Literatur kommt die Schwierigkeit, die bei der Bestimmung des Begriffs besteht, vielfach zum Ausdruck. In den Kommentaren zum Grundgesetz wird etwa festgestellt, dass es einen allgemein akzeptierten, dogmatisch präzisen Rechtsbegriff der Menschenwürde nicht gebe. Ein operabler Begriff der Menschenwürde harre immer noch der Entwicklung. Das Zusammentreffen von fundamentaler Bedeutung und inhaltlicher Unbestimmtheit ruft nach theoretischer Reflexion. Dabei ist klar, dass gerade in der relativen Unschärfe und Offenheit des Begriffs der Menschenwürde auch ein Vorzug liegt. Gerade weil dieses Konzept so vage ist, kann es einen konsensfähigen Grund kollektiver Ordnung bilden. Die folgenden Überlegungen wollen dem Rechnung tragen und sind nicht von der Absicht geleitet, den Begriff abschließend zu definieren. Eher liegt das Ziel der Studie in einer Annäherung an den begrifflichen Gehalt der Menschenwürde. Disziplinär ist die folgende Untersuchung in erster Linie der Philosophie zuzuordnen, insbesondere der Rechts- und Moralphilosophie. Es handelt sich nicht um eine rechtswissenschaftlich-dogmatische Arbeit. Das Ziel der Arbeit besteht mithin nicht darin, den Rechtsbegriff der Menschenwürde auszulegen. Jedoch hat die Studie auch eine rechtlich-praktische Zielrichtung. Sie soll, auf philosophischer Grundlage, auch den Rechtsbegriff der Menschenwürde besser verstehen helfen und damit auch der juristischen Interpretation dienlich sein. Im dritten Teil wird die Arbeit daher Bezüge zum positiven Recht herstellen und eine juristische Interpretation des Begriffs vorschlagen. Bevor die Untersuchung einsetzt, ist eine kurze Verständigung darüber nötig, von welchem Begriff der Menschenwürde im Folgenden ausgegangen wird. Der Begriff kann unterschiedlich verstanden werden. Insbesondere bestehen Vorstellungen einer (wie man sagen kann) inhärenten und einer kontingenten Würde. Nach der ersten Vorstellung hat jeder Mensch eine Würde, die er nicht verlieren kann. Nach der zweiten Vorstellung ist Würde dagegen etwas, das ein Mensch je nachdem in größerem oder kleinerem Ausmaß besitzt. Die folgenden Überlegungen gehen von der Idee der inhärenten Würde aus. Diese Würde kann verletzt oder missachtet werden, sie kann dem Menschen aber nie eigentlich genommen werden. Die Menschenwürde auch in diesem Sinn basiert jedoch auf einer Zuschreibung. Der Mensch hat Würde nicht, wie er zwei Beine hat. Die menschliche Gemeinschaft schreibt sie ihm als unverlierbar zu. Es handelt sich bei dieser Zuschreibung mithin nicht um eine deskriptive, sondern um eine präskriptive Aussage. Gerade darin manifestiert sich der unverlierbare Gehalt der menschlichen Würde – denn in einem deskriptiven Sinn verstanden, kann diese durchaus verloren gehen. Ein Mensch kann faktisch unwürdig leben, entwürdigt werden, seiner Würde verlustig gehen. Das präskriptive Verständnis dagegen statuiert eine Würde, die alle faktischen Gegebenheiten überdauert und in jedem Fall besteht. Die folgenden Untersuchungen wollen diese Würde erläutern, aber nicht begründen. Denn nach hier vertretenem Verständnis bildet die Menschenwürde selbst den Grund der normativen Forderungen von Moral und Recht. Es gibt insoweit nichts weiter zu begründen – während die Würde, wie aufgezeigt werden soll, tatsächlich den Grund der Menschenrechte bildet. Insoweit – beim Verhältnis zwischen Menschenwürde und Menschenrechten – liegt ein Begründungsverhältnis vor. Dieses wird vor allem im zweiten Teil der Arbeit näher diskutiert. Im ersten Teil soll versucht werden, in einem allgemeinen, moralphilosophischen Sinn ein Verständnis der menschlichen Würde zu gewinnen. Dazu ist es zunächst nötig, sich die wichtigsten bestehenden Theorien zur Menschenwürde zu vergegenwärtigen. Die Auseinandersetzung mit diesen Theorien wird ein Defizit aufzeigen. Diesen Analysen schließt sich eine eigene Interpretation an, die am Schluss des ersten Teils mit einigen möglichen Gegenargumenten konfrontiert werden soll. (shrink)
